The Political Spectrum

One of the institutions that emerged from this war was the league of Nations, a forerunner of the get together Nations but with little authorization or power and destined to fail as an judge of international matters. There were various precedents for international arbitration crimson at that time, though, and among the other institutions that emerged, based on such precedents, was history's original permanent international law court, the Permanent Court of worldwide Justice, as part of the League of Nations. This court would collapse on with the League of Nations in 1945, but a more or less identical tribunal, the International Court of Justice, would replace it as the judicial branch of the new United Nations. Even then, two of history's fundamental hassles in law would remain. The first was the question of how states could be encouraged or compelled to submit their conflicts to judges for settlement; the minute was how international judicial decisions, once rendered, could be effectively enforced. The problem with the League of Nations was that it lacked the needed homogeneity among its members to get these things done (Craig and George 53-58).

Although it did represent a legally authorized process by the Security Council and was an international effort to reverse a clear case of aggression, it lacked the legitimacy implied by the concept (Stiles 155).

UN involvement has been described as a diplomatic happy chance because the beginning of that conflict came at a time when the Soviet Union was boycotting the Security Council and so was not available to forbid the action. The United States led the action even after the UN voted to operate involved, and UN support was marginalized further once the Soviets began vetoing efforts to provide support. The action has been seen as violating the principle of collective security:

The UN has also failed to take action in many instances where it might have been an effective peacekeeper, but this should not negate the successes the organization has had nor undermine the real richness of the organization as a symbol of international commission to peace.
